All entrants are strongly encouraged to consult a physician to ensure safe weight loss practices prior to entering and during the Contest (defined below). Participation in the Contest may challenge and engage your physical and mental resources. You should not participate in the Contest if you have any health conditions affecting your ability to participate. Any information (including, without limitation, any information about weight-loss or healthy lifestyles) provided by Sponsor (defined below), Southland Health Alliance, or any Participating Hospital (defined below) is for informational purposes only and should not be relied upon in place of consultation or advice from your physician or other health care provider. By entering, you acknowledge that you understand and assume any and all health or other risks involved in participating in the Contest. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Registration for the Lose to Win Contest (the “Contest”) begins January 29, 2008 and ends January 31, 2008 (the “Entry Period”). The 10-week weight-loss competition begins January 29, 2008 and ends April 10, 2008 (“Contest Period”). 1. HOW TO ENTER. To enter the Contest, visit one of the Weigh-In Locations listed below during the Entry Period during one of the times set forth below, show a valid photo ID, participate in your first weigh in, hand-in your signed Release (defined below) and submit a 50 word essay on “Why you want to choose a healthy lifestyle.” The Weigh-In Location at which an entrant enters the Contest is the location at which all weigh-ins during the Contest Period must take place for that entrant. Also, the Weigh-In Location at which an entrant enters the Contest is the Weigh-In Location at which that entrant is competing for purposes of the weekly prizes (described in Paragraphs 3 and 4 below). “Weigh-In Locations” and “Weigh-In Times”You must register during the Entry Period at one of the Weigh-In Locations listed below during one of the days and times listed below during the Entry Period. To be eligible for weekly prizes, you must always weigh-in on the same day of the week. To be eligible for the grand prize, you must participate in your final weigh-in on the same day of the week as your initial weigh-in.
As part of the entry process, all entrants will have their initial weight documented and have a “before” photograph taken. All entrants will also be required to sign an Affidavit of Eligibility and Liability/Publicity Release Form and HIPAA release (together “Release”) and receive information about healthy lifestyle and safe weight loss. Limit one (1) entry per person. All entry materials become property of The SouthtownStar (“Sponsor”) and will not be returned. For each weigh-in, all entrants will be required to remove their shoes, hats and any jackets (including, without limitation, blazers and sport coats). 2. ELIGIBILITY. The Contest is open to legal residents of Cook or Will Counties in Illinois or Lake County in Indiana who are aged eighteen (18) years or older, except that any employees of Sponsor, the Southland Health Alliance, or Little Company of Mary Hospital and Health Care Centers, Silver Cross Hospital, Ingalls Health System, Advocate Health Care or Palos Community Hospital (collectively, “Participating Hospitals”) are not eligible to win a prize in this Contest. Also, anyone who has undergone bariatric or any other weight loss surgery (including, without limitation, liposuction) or anyone taking prescription medications or dietary supplements for weight loss (unless as directed by a medical professional) is not eligible to enter or win a prize in this Contest. Moreover, anyone who undergoes bariatric or any other weight loss surgery (determined by Sponsor in its sole discretion) during the Contest will be automatically disqualified. Note that neither Sponsor nor any of the Participating Hospitals have the obligation to monitor these prohibitions; however, if they are discovered, the entrant will be disqualified. All U.S. federal, state and local laws and regulations apply. Void where prohibited. All entrants acknowledge and agree that, in addition to the publicity consents given in Paragraph 7 below and in the Release, entrants, their photographs and/or their essays may (in Sponsor’s sole discretion) be mentioned or featured in weekly articles appearing in The SouthtownStar newspaper. SELECTION OF WINNERS. Throughout the Contest Period, there will be twenty (20) weekly prize winners selected from each Participating Hospital (one (1) male weekly prize winner and one (1) female weekly prize winner per Participating Hospital for each of the ten (10) weeks of the Contest Period) and, at the end of the Contest Period, there will be two (2) grand prize winners selected overall (one (1) male grand prize winner and one (1) female grand prize winner). During the Contest Period, each entrant must participate in a weekly weigh-in at the Weigh-In Location at which he/she originally entered the Contest. Weekly weigh-ins will be conducted during the Weigh-In Times in number 1 above each week during the Contest Period and the entrant will be required to show a valid photo ID during each weigh-in. To be eligible for a weekly prize, you must have had an eligible weigh in that week and the week prior with no more than seven (7) days since the last weigh-in. Each week, the one (1) male and one (1) female eligible entrant from each Participating Hospital who loses the most weight (calculated as a percentage of total body weight) from the prior week’s weigh in will be the weekly prize winners. At the end of the Contest Period, the one (1) male and one (1) female eligible entry from among all entrants who loses the most weight (calculated as a percentage of total body weight) during the entire Contest Period will be the grand prize winners. To be eligible for the grand prize, you must participate in your final weigh-in on the same day of the week as your initial weigh-in. In the event of tie for a weekly winner or the grand prize winners, the essays for the tied entrants will be judged by Sponsor’s designated judges based on the following criteria: originality and responsiveness to the topic. The tied entrant with the highest score will be deemed the weekly or grand prize winner, as applicable. In the event of tied essay results, the person with the higher score in the responsiveness to the topic category will be deemed the weekly or grand prize winner, as applicable. The weekly winners will be notified on or around the Friday after each weigh-in period by telephone and/or e-mail and may (in Sponsor’s sole discretion) be published in the following week’s SouthtownStar newspaper and web site. The grand prize winners will be notified that they may have won a prize in this Contest by mail, telephone or electronic mail (at Sponsor’s sole discretion) within fourteen (14) days of the last weigh-in and may (in Sponsor’s sole discretion) be published in the SouthtownStar newspaper and web site. If any prize notification, prize, or Contest communication is rejected or returned as undeliverable or if the winner cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), such winner may be disqualified and an alternate winner may be selected using the process described above. PRIZES. Weekly Prizes (10 per week): each, a $25 check or gift card (in Sponsor’s sole discretion). There will be one female and one male winner each week from each of the Participating Hospitals. Approximate retail value (“ARV”) of all weekly prizes: $2500. Grand Prize (2 total): each, a $500 check. There will be one female and one male grand prize winner. ARV of grand prize: $1000. Total ARV of all prizes in this Contest: $3500. All federal, state and local taxes, as well as any expenses not specified in these Official Rules are the sole responsibility of the winner. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute the stated prize, or any portion thereof, with another prize of equal of greater value should the stated prize become unavailable. LIMITATION OF LIABILITY: EACH ENTRANT AGREES TO RELEASE, HOLD HARMLESS AND INDEMNIFY SPONSOR, SOUTHLAND HEALTH ALLIANCE, PARTICIPATING HOSPITALS, WEIGH-IN LOCATIONS, AND EACH OF THEIR RESPECTIVE PARENTS, DIVISIONS, SUBSIDIARIES, AFFILIATES, ADVERTISING, PROMOTION, AND PUBLIC RELATIONS AGENCIES, AND THE RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENCIES OF EACH FOR ANY LIABILITY WHATSOEVER FOR ANY INJURIES (INCLUDING, WITHOUT LIMITATION, HEALTH-RELATED INJURIES) OR OTHER DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH PARTICIPATING IN THIS CONTEST (INCLUDING, WITHOUT LIMITATION, WHILE PREPARING FOR AND/OR TRAVELING TO OR FROM ANY PRIZE- OR CONTEST-RELATED ACTIVITY OR AS A RESULT OF THE ACCEPTANCE, POSSESSION, USE, MISUSE OR AWARDING OF A PRIZE), INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY. ENTRANTS UNDERSTAND AND AGREE THAT OVERSIGHT OF THE CONTEST BY SPONSOR, THE SOUTHLAND HEALTH ALLIANCE, OR ANY PARTICIPATING HOSPITALS DOES NOT AND CANNOT GUARANTEE ANY ENTRANTS’ SAFETY. WINNERS AGREE THAT PRIZES ARE PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. Sponsor is not responsible and/or liable for any of the following, whether caused by Sponsor, the entrant, or by human error: any lost, late, incomplete, illegible, mutilated, misdirected or postage-due mail; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions or failures of electronic equipment; or errors, typos, or misprints in these official rules, in any Contest-related advertisements or other materials. GENERAL RULES. By entering this Contest, each entrant agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest activity. Each entrant understands and agrees that Sponsor has the right, in its sole discretion, to disqualify and remove the winner from the Contest at any time if the entrant’s behavior at any point is disruptive or may or does cause damage to person, property or the reputation of Sponsor or otherwise violates the policies of Sponsor, the Southland Health Alliance, or the Participating Hospitals. By entering the Contest (except where prohibited by law), entrants consent to the use of their names, pictures, likenesses, voices, biographical data, and/or any information contained in their entry (including, without limitation, their “before” photographs) in advertising, promotion and marketing materials throughout the world, including on the internet, by the Sponsor, its promotional partners, and third party marketing entities, without additional compensation, notice, review, or approval. Sponsor’s decisions will be final in all matters, including interpretation of these official rules and selection of winners. All participants, as a condition of entry, agree to be bound by these official rules and the decisions of Sponsor. Failure to comply with these official rules may result in disqualification from this Contest. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these official rules. Participants further agree to not knowingly damage or cause interruption of the Contest and/or prevent others from using the Contest. If the Contest is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest. Any person who supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these official rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law.
